San Diego-based Illumina said today that it has been served with a complaint alleging patent infringement, from Carlsbad-based Life Technologies. According to Illumina, it is being sued by Life Technologies, Applied Biosystems, a Russian research institute, and the holders of patents which Life Technologies said are being infringed upon by Illumina in its Genome Analyzer System. Illumina said it will "defend this suit vigorously" claiming that the claims are "unfounded". The patents in questions are U.S. Patents 5,616,478; 5,958,698; and 6,001,568. The suit was filed in the U.S. District Court in Wilmington, Delaware.
